Conflict of Interest Forms and Instructions

      Chapter 176 of the Local Government Code; was adopted by the Texas State Legislature in 2005 through House Bill 914. In 2007 House Bill 1491 amended Chapter 176 to clarify the requirements of the legislation. Chapter 176 requires public disclosure of a BUSINESS RELATIONSHIP between a person or his agent (hereinafter referred to as vendor); and an OFFICER, elected official, or DESIGNATED EMPLOYEE (hereinafter referred to as member) of the LOCAL GOVERNMENT ENTITY or his/her FAMILY MEMBER.

      By definition, a school district is specifically identified as a LOCAL GOVERNMENT in the letter of the law [Sec. 176.001(3)].

      Failure to comply with the requirements set forth under Chapter 176 of the Local Government Code can result in criminal penalties.  

      - VENDORS NEED TO KNOW -

      In accordance with Section 176.006, each vendor who has or seeks to have a business relationship with Schertz-Cibolo-Universal City I.S.D. must complete a CONFLICT OF INTEREST QUESTIONNAIRE (form CIQ)

      1) if the vendor has an employment or another business relationship with a member of SCUCISD, or his/her family that results in taxable income (other than investment income) in excess of $2,500 during the 12 month period preceding the date that the member becomes aware of the business relationship or an impending business relationship.  Be advised this question refers to an employment or business relationship with the member, other than that which the member would conduct on behalf of the school district

      2) or if the vendor has given a member of SCUCISD, or his/her family, gift(s) with a combined value in excess of $100 during the 12 month period preceding the date that the member becomes aware of the business relationship or an impending business relationship; except for: gifts given by a family member of the person accepting the gift, political contributions and gifts of food, lodging, transportation, or entertainment accepted as a guest [Section 176.003 (a-1)].

      Subsequently, each vendor must file an updated questionnaire annually by September 1 each successive year, except when the most recent questionnaire was submitted between June 1 and September 1. A new questionnaire must be filed within seven business days after any event that alters the accuracy or completeness of the preceding statement.

      The vendor must file the questionnaire (form CIQ) with the records administrator for SCUCISD no later than the 7th business day after;

      -he/she enters into or seeks to enter into a business relationship with SCUCISD or

      -the date the vendor becomes aware of an employment or other business relationship with a member of SCUCISD or his/her family member or

      -the vendor has given one or more gifts with a combined value in excess of $100 to the member or his/her family member, except for gifts from a family member of the person accepting the gift, political contributions and gifts of food, lodging, transportation, or entertainment accepted as a guest.

      - ELECTED OFFICIALS & LOCAL GOV'T OFFICERS NEED TO KNOW -

      Section 176.003 of the Local Government Code provides that elected officials, officers and designated employees (member) of SCUCISD must file a CONFLICTS DISCLOSURE STATEMENT (form CIS) with the SCUCISD records administrator if:  

      1)  he/she or a member of his/her family is employed by or has a business relationship with a vendor who contracts with or begins contract negotiations with the local government and that relationship results in taxable income (other than investment income) for the member or his/her family member; in excess of $2500 during the 12 month period preceding the date that he/she becomes aware of the contract or proposed contract

      or if

      2)  the member or a member of his/her family accepts gifts from a vendor who enters into a contract or seeks to enter into a contract with the local government worth in excess of $100 during the 12 month period preceding the date he/she becomes aware of the contract or proposed contract;  except for: gifts given by a family member of the person accepting the gift, political contributions and gifts of food, lodging, transportation, or entertainment accepted as a guest [Section 176.003 (a-1)].

      In accordance with Section 176.009, Local Government Code; The SCUCISD records administrator must file each completed conflict of interest questionnaire and conflict disclosure statement and make them available to the public on the school district website.

      In accordance with Section 176.007, The District must make a list of SCUCISD officers and elected officials available to the public upon request.

      The District is not required to provide any further interpretation or information regarding the requirements set forth under Local Government Code, Chapter 176.

      SCUCISD is not required to ensure that a person (vendor or his/her agent) described by Section 176.002 files a Conflict of Interest Questionnaire, [Section 176.006 (h)].
